1          About the terms 

1.1       What these terms cover. These are the terms and conditions on which we supply products to you, whether these are goods, services or digital content. 

1.2       Why are these Important to read. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information.

3         Our contact with you 

3.1     How we accept your order. Once your order is confirmed and you have received an email to confirm, we have now entered a contract with you. 

3.2     Your order number. Once you have placed an order, you will be allocated an “order number” this should be used in any correspondence with us. 

3.3 If we cannot fulfil you order. Sometimes we might not be able to fulfil your order because stock is not available or a pricing and description error. We will notify you in writing. 

 

4        Delivery  

4.1     All delivery information is available on the website including costs of shipping and expected delivery times. We are not responsible for delays once the items are with the courier company, this is out of our hands. We will of course do everything in our power to help speed up any problems you might have. 

 

5        Products 

5.1     Products may vary in terms of packaging , pictures etc in terms of what is listed on the website. Images are for illustrative purposes only.  

 

Electric Travels ltd have the right to cancel any order where the company has made a pricing error. The customer will be advised and a full refund is allowed if the new price is not acceptable. 

 

 

6        Responsibility of goods. 

6.1     Electric travels own the goods until fully delivered and signed for at your delivery address. Ownership of the items become yours once full payment and delivery have been made.  

 

7       Your rights to cancel 

7.1     If you have changed your mind about the product. You have the right to cancel and request a full refund within 14 days’ time. Refund will be on the promise that item is unused and returned in full retail packaging with no parts or instructions missing. You are liable to face charges for shipping the item back. 

7.2    If we have done something wrong. You have the right to cancel your contract with us if: 

We have advised you about an upcoming change to the product. 

We have advised you about a pricing error. 

We have advised you about a description error. 

The products face severe delays in arriving with you (outside of our control) 14 days from date of order. 

7.3    Exercising your right to change your mind. You have a legal right to change your mind within 14 days and receive a full refund. These rights under the consumer contracts regulations 2013 are explained below: 

You have 14 days from the time you receive the goods. Goods must not have been used. 

 

If there is a problem with the product.  

8.1  Your legal rightsWe as a company have a legal duty to supply products that are of satisfactory quality and are in conformity with this contract. Nothing in these terms will affect your legal rights. 

8.2 If you have a faulty product. Please advise us immediately in writing to Info@Electric-Games.co.uk or in the post to; Electric Travels Ltd, Warwick House, 65-66 Queen Street, London EC4R 1EB. 

8.3 You have 30 days to claim a full refund for any faulty product 

8.4 If your product develops a fault after 30 days through normal use , you may still be covered under the manufacturer’s warranty. 

(Normal use is defined under the manufacturers warranty. The warranty will not cover consumable parts such as wheels, cables, brakes, headsets or button brackets) 

Please email Info@Electric-Games.co.uk with your order number and as much information about the fault and how it occurred. We can offer guidance from here about how best to get it repaired. 

 

Payments 

9.1 Payment InformationAll items must be paid in full before we can release goods to you. We accept, Maestro, Visa, Amex, Apple Pay, Google Pay, Shop Pay and Paypal

All prices are inclusive of VAT. 

9.20 RefundsAll refunds must be paid back to the original payment method. Refunds can take up to 7 - 10 working days to be processed into your account.

 

10        Our responsibility for loss or damage suffered by you 

10.1      We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process. 

10.2      We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products including the right to receive products which are: 

10.2.1         as described and match information we provided to you and any sample or model seen or examined by you; 

10.2.2         of satisfactory quality; 

10.2.3         fit for any particular purpose made known to us; and 

10.2.4         for defective products under the Consumer Protection Act 1987. 

10.3      We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. 

 

11 Other information 

11.1 Liability. To the extent not prohibited by law, we accept no liability for any: loss which is not foreseeable (loss is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time you and we entered into our contract) loss which arises when we are not at fault or in breach of these Terms and Conditions business loss (which includes loss of profits, loss of business, contracts, goodwill, business opportunity and other similar losses, as well as business interruption). Nothing in these terms will affect any liability we may have: (a) for fraudulent misrepresentation; (b) for death or personal injury arising from our negligence: (c) under Part I of the Consumer Protection Act 1987; (d) for breach of any condition as to title or quiet enjoyment of or in relation to any goods supplied by us; or (e) in relation to any other liability, including any liabilities under sale of goods or supply of services legislation, that may not by applicable law be excluded or limited. 

 

11.2 General. If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, the validity, legality or enforceability of any other part of these Terms and Conditions and the remainder of the provision in question will not be affected. No person other than you and us shall have any rights to enforce our agreement, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise. If we fail to insist that you perform any of your obligations under our agreement, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you. You may not assign or transfer your rights or obligations under our agreement, unless we agree in writing. We may update, vary and amend these Terms and Conditions from time to time without prior notice. Each time you order or otherwise purchase any goods from us, the Terms and Conditions in force at that time will apply (as set out on this site). Please check this site to ensure that you understand which Terms and Conditions apply.
